Comment in your other post assumes child support was "taken" out of his check or wages...That is probably what can't be altered without a judges order...However, he may have been paying on his own...they only garnish wages when someone has had issues paying, I thought..As long as they pay timely, courts probably don't step in...

It's not true that they only deduct CS payments if someone has a problem paying...at least not in PA. Child support payments go through Domestic Relations, and it is deducted from the paycheck. That's the way it works in PA.

Federal and state law requires that a parent’s child support obligation be automatically deducted from his or her paycheck through a garnishment or income withholding order. The only exception is if the person is self-employed.

After the support order is established, Domestic Relations issues an income withholding order to the defendant’s employer to deduct the support from wages or other forms of income.

In Pennsylvania, when a couple is divorced, usually child support is requested at the same time. Both parties show up for the hearing at the Domestic Relations office, where they present pay stubs, expenses, etc., and DR calculates how much the other parent would owe. After hearing the amount, both parties may negotiate at this time. If the spouse claims the amount is too much, the other parent may agree to accept less. If no agreement is reached, the officer presents the calculations to the judge, who makes the decision. Once the decision is made, that amount is deducted from the spouse’s paycheck through his employer. They cannot agree that the other parent pays “on his own.” Payments must go through DR. It’s the law.

When the Child Support payments go into effect, they cannot be raised, lowered, or wiped out without the approval of Domestic Relations. The parent, out of the goodness of her heart, cannot say that she no longer wants payments. Domestic Relations put the order into effect, and it is Domestic Relations who makes any changes.

I live in PA and My ex's child support was not garnished from his wages until I took him to court for not paying. It depends on how you set it up or on how your divorce agreement is determined.

Single Mom...I think it's that way most places...Most people commenting have probably not been through the experience and are basing opinions on someone they know and what happened to them...I know in NC, courts don't garnish unless they HAVE to...And I don't believe child support is a mandatory thing...If one parent is far more well off than the other, then they don't HAVE to take a dime from the other parent...It would be stupid to force the parent who forgives the child support to take the money because all they have to do is just give it back to the other parent after he pays it...

i just went into the PA web page for frequently asked questions on child support. One of the questions is on payment, and checks/money orders are listed as well as setting up a monthly auto-withdraw from you bank account. So it does not appear wages are always garnished.

It also discusses reasons for modifying an existing child support order. Private agreements are listed as a reason, so it appears that you can reach an outside agreement, but the court order must be modified which requires the approval of a judge.

And Kate's lawyer commented on her doing that..so I have to assume all is legal and well and Jon no longer pays child support and Kate has his gonads in a jar beside her bed...Just that simple:)

There's a family member who is going through this very thing right now. PA child support law is very clear about this.

I really wish Jon would speak up and tell his side of things (but maybe he is trying to keep the peace for the sake of the kids). It just makes it look bad for him..like he is just letting Kate walk all over him and get whatever she wants. I guess I just wonder how she is getting all of the money that she seems to have to do all of the traveling, keeping up the maintenance on the huge home, private schools etc..all on her own. She is not working, and I would think that her TLC money would run out eventually. Her books are not successful, her cruise was cancelled due to lack of interest, and she does not seem to have much going on. None of my business, but I would think that she is basically just spending money frivolously for someone who is not working, and apparently has no prospects.

It's being reported that Mama June (from Honey Boo Boo fame) has a huge portion of the money from the show deposited straight into 5 trust funds (one for each girl), without even coming to her first. They mostly live off what the dad earns because she doesn't want to be "like those other reality TV people."

Woke up this morning and turned on my TV in the living room. It was on TLC from the night before (Honey BooBoo...that's a whole other story) And I heard the Kate Plus Eight Theme Song, and sure enough there it was, the show is back.It was that horrible episode in NY where she tries to give ice cream on top of the bus and screams about it melting. What is TLC thinking?

Isn't it great to hear kate screaming and running in her stilletos with the ice cream through the streets of NYC, then up to the double decker bus, shoves Joel? back hard and gripes about it melting? NOT!

It would of been EASIER to put the ice cream in cups with lids, would not of melted so fast OR just bought a gallon, a scoop and some bowls and spoons and dished it out.

But that is just toooooo haaaaaardddd!

On Radaronline, they have a story about Jon having a 39K lien that has not been taken care of since 2009. Well, what about kate? Isn't she responsible for half of that? Did she shove that to him in the divorce. She is just an incredible dead beat. Sounds like this is like the bill for the mental health bill the dr. billed kate for and she didn't want to pay and shoved it on Jon.

TMZ screwed up. The tax bill is for the State of PA, not the IRS. Moreover, Jon's entire social security number appeared on the doc. TMZ failed to redact it for several hours. It was faxed from the Berks County Prothonotary office. Time stamp is on the document.

Their divorce decree - did it indicate they would file joint or
separately that yr and their deductions. Who or both split the kids??
One would think with all their expertise helpers one would have cked this out. Sometimes it takes forever to work thru these liens.
Does anyone know if their decree is
public information??

I do wish someone from Jon`s camp would comment on it.

Jon had to pay his half of the marriage counseling and Kate got off the hook.

I do wonder if they have Kate also has issues with the IRS/TAX. However, they don`t post in free of Kate lawyers.

Didn't the Gosselins divorce in the summer of 2009, making them both responsible for 2009 tax liens?

The Gosselins separated in June, 2009. I don't remember when the divorce was final. If a couple is divorced by December 31, then they may file completely distinct taxes for the year.

Once Jon catches up his "arrears" he owes no more child support legally....Kate now has his gonads beside her bed in a jar...Do you really think for one second he's going to ever "report" anything she does not exactly "legal"?I seriously doubt it because he will do whatever to avoid having to pay out anymore money to Kate if he doesn't have to...Kate can make any "arrangement" under the table she wants to and Jon really has no choice at this point...It's not illegal if a judge or prosecutor doesn't KNOW anything, now is it????

Of course it's still illegal. Is it illegal if an employee embezzles money from a company without the employer knowing about it? Yes! Just because those in authorities don't know about it doesn't make it legal! Why would you risk getting caught?

Once child support is terminated, you cannot go back into court and want it reinstated. Well, you can, but it's not going to fly. Once it's dismissed, it stays that way.

Jon doesn't owe that to the IRS; he owes it to the state. Uncle Sam (the IRS) and the PA Dept. of Revenue are two separate entities. There are county taxes, state taxes and federal taxes (the IRS). This one is for state taxes, as can be seen by reading the document that TMZ published.

I suspect, when Jon started paying child support it was not deducted from his pay check, for one key reason. He did not have a "regular" job so he did not receive a pay check. His income came from public appearances, interviews, photos, etc. For this he would be given a fee (no deeductions) from which he would be responsible for pay taxes, child care, etc. Still, he would not have been given the CS directly to kate. It would have been paid to the State, by check, money order, or online payment, and the state would have sent it on to kate. After a year or so, when he started his regular job (I believe in was in solar panels, but I may be remember wrong), the state may have started payroll deductions for CS.

Xanadu and others who take my words literally...WAS BEING FACETIOUS:)....I'm just saying Jon has a good thing going now...He ain't gonna blow it by telling the judge Kate won't let him (fill in the blank)...Kate will have full say so about those kids until the day they turn 18...It's a shame, but Jon really only has himself to blame...perhaps when the kids are a little older, it will be harder for Kate to deny them visits with Jon when they are basically demanding to see him...It will be a hard sell for her to convince anyone the kids "want to be with her ALL THE TIME" the way she does now...

Not necessarily. The twins right now could decide with whom they want to live. In PA, there is no set age for deciding where to live. It
is not a magical number. Many states do not allow a child to choose where they live until they reach a certain age. Not so in Pennsylvania. In fact, children as young as seven or eight have the right, in PA, to go before a judge and request a change with whom they live. Nobody knows what the future holds for them, and if any of them want to live with Jon before they are 18 and the court rules in their favor, Kate will have no say in what they do until they are 18.

That is interesting. Especially since the entire Xmas holiday, she has not posted one pic of the kids or said one thing about the tups. She references the twins occasionally. This made me think that the tups are spending the bulk of their time at Jon's. But - do you think this is because that's what the tups want or because kate is so done with them as they are no longer money makers? If the tups want to be liberated from the KONpound, would they even have the courage to say they prefer to be with Jon? Kate terrorizes them constantly and uses threats to control them. I would like to think that they have been liberated and are with Jon. Then, Kate would also have to pay child support to him.

Since Jon was not "Employed" in the classica sense that year, his income came from paid appearnces etc. he would have been given a fee. Not only income taxes but pay roll taxes would not have been withheld. It's a good possiblity the 39K includes SS and medicare payments as well as income tax.

radaronline always puts her in a positive light. But no one is fooled anymore, as you can read from the blogs. As a real soccer mom with kids in their 20 today, that is bull she does what is required, and that is putting in the time for games and practices..
Regardless of her looks, which we would all would look better if our main focus was ourselves instead of our families needs... i was always surprised no one saw thru a women with 8 kids, all on her own..lol.. gets her nail done once a week..You cant undo knots from a soccer cleat with nail like that, much less laundry.
Her kids will love her because she is there mother, she will never appreciate them and will probably blame them for her not being the start she thinks she should of..

I think, then, that if one doesn't know, then there shouldn't be accusations made that the kids are kept in a prison with no contact with the outside world. It's just not true.

Kate Gosselin is in the middle of another nasty battle, and it may be the ugliest one ever!

A war between pro- and anti-Kate camps has been raging on Twitter, but now it’s gone nuclear as the group @Bullyville named what they claim is Kate’s stalker, RadarOnline.com is reporting.

And that stalker, they claim, is a senior citizen — a 62-year-old woman! (Radar is not naming that person or giving out her Twitter account.)

Bullyville posted a screen grab on Monday of a tweet apparently sent to Kate containing what appears to be a chilling threat plus profane, abusive language.

The tweet was sent to the mom of 8 on her birthday and read “happy bday o a GRIFTING, stealing, lying child & animal abusing (censored) (censored). Hope u choke on ur birthday cake. REMEMBER SELENA.”

Selena, the superstar singer, was murdered by the president of her fan club.

On Sunday, Bullyville announced that it was taking action against the Kate haters who it believed had crossed the line, with this tweet: “We’re launching #opkatehate effective tomorrow. These bullies have collectively pissed off the hive, it’s too late to #expectus.”

The site followed with “we now know where all of @kateplusmy8 bullies work. Employers sure don’t seem to like negative media attention.”

Those tweets took the battle over Kate to a new, even more fierce level, with her detractors – and some apparent onlookers – turning up the heat on the conversation.

One person wrote about Kate and Bullyville: “She’s still a documented child abuser..makes no sense they would align themselves with her.”

Kate was accused of child abuse by Robert Hoffman, a pal of Jon Gosselin, who wrote an e-book documenting boorish behavior by Kate, who admits she has spanked her children with a wooden spoon.

Hoffman told RadarOnline.com previously that he called the Department of Children’s Services on Kate and launched a complaint.

One anti-Kate person remarked about the newly named Kate basher, “Maybe the old lady should actually be KILLED…what do you think?” (The tweet was later deleted.)

The person named as Kate’s ‘stalker’ allegedly sent 74,000 anti-Kate tweets.

One of Kate supporters begged everyone on Twitter to leave her alone and said: “kate is scared and would like you to stop harassing her. how about you do that? walk away?”

But that logic did not resonate and drew this response from one of the many people suddenly in the battle: “Tell Kate to call the police & complain that she sent ppl to kill me but I’m refusing to die.”

In the neighborhood...I think if one doesn't KNOW the poster of the post they are referring, then they should just not post an accusatory random post quoting the person who had absolutely never referred to Kate keeping her kids in a prison...If you want US to do our research, I would request YOU do a little yourself and take time to find the quote of the person who actually posted what you are writing about...Make sense??? In other words, you used my quote to chastise the one who referred to Kate keeping her kids in a "prison"...That was not me...I truely love the couple of people on here who "personally" know Kate and correct us with their "inside" knowledge of the "facts"...

Kate and Bullyville have teamed up to rid her Twitter from haters. They are outing "innocent" people and it's going to backfire on them bigtime.
